The criminal record certificate that says nothing: Spain annuls two million

The Audiencia Nacional overturns the Spanish authority's fine: asking for a CLEAN criminal record certificate is not, in itself, processing conviction data under Article 10. That does not mean you may always ask

What the court decided

The Spanish authority had fined two million euros the practice of asking candidates for the Amazon Flex programme — couriers delivering with their own vehicle — to produce a criminal record certificate. In judgment no. 359/2026 of 8 July 2026 the Audiencia Nacional annulled the fine: Article 10 GDPR governs data "relating to criminal convictions and offences", and obtaining a certificate attesting the absence of convictions is not the same as learning of a conviction. An appeal to the Supreme Court is still possible.

Reading the headline, the temptation is to conclude that the certificate may now be requested. That is not what the judgment says. The court removed ONE obstacle — automatic classification as Article 10 data, which requires a reinforced legal basis — and left everything else standing. The certificate remains personal data, and asking for it remains processing that needs a legal basis and must pass the necessity test.

  • The document still contains personal data: name, date of birth, and the very fact that this person was subjected to a check.
  • A legal basis under Article 6 is required, and for a private employer the candidate's consent does not hold: in a recruitment relationship it is not freely given.
  • The necessity test remains: for a specific role the certificate may be proportionate; for every position indiscriminately it is not.
  • National law matters more than the judgment: in Italy, Article 2-octies of Legislative Decree 196/2003 requires a legislative provision for Article 10 data, and asking candidates for the certificate is allowed only where a law provides for it.

And there is the other side, which a DPO must keep in mind. The opposite view exists and has been argued forcefully: a clean certificate still says something about the person — precisely, that they have no convictions — and that is information about their judicial past, even when the box is empty. It is the position from which the Spanish fine arose, and the one that guides practice today in several jurisdictions, Italy among them.

How to use a judgment that is not final

Not as a green light. A first-instance ruling, still appealable to the Supreme Court and delivered under a different national law, is not a basis for changing a client's practice. It is, however, an excellent reason to re-read the certificate requests the client already makes: if they make them because "it has always been done this way", this judgment does not save them; if they make them because a law requires it, they never needed it.

The practical question to take to the client is the same as before the judgment, and there is only one: for which role, and under which provision. If both have a written answer, the request holds under any reading of Article 10. If the answer is that they ask everyone because it is safer, safety lies precisely on the other side.

Real employee data inside the test system: what loss of control is worth

Testing a new HR system with real data is not forbidden: transferring more fields than the test needs is. The German Federal Labour Court ordered an employer to pay two hundred euro because it had uploaded salary, home address, tax ID and marital status although it had agreed a list of nine fields with the works council. And it confirmed that a delayed answer to an access request is not, in itself, a damage.

Legitimate interest is not the fallback legal basis

In Case C-621/22 the Court of Justice held that a commercial interest can constitute a legitimate interest under Article 6(1)(f). Many people read only that line. The rest of the judgment recalls that the conditions remain three and cumulative, and that the third - the balancing against the data subject's reasonable expectations - is where the case at hand was lost. For the DPO the consequence is practical: legitimate interest exists only if it is written down somewhere.
